AUSTRALIAN FITNESS EXPO SEPTEMBER 2025 CONSUMER COMPETITION
Terms and Conditions
1. The Promoter
CW Media PTY LTD ACN 606 548 298, ABN 43 913 252 975, 6 Albert Street Preston, Vic 3072, on behalf of the Chemist Warehouse and e-Pharmacy group.
2. Terms of Entry
2.a Competition entries can be made from 00.01am AEST on Friday 19 September 2025 until 11.59pm AEST on Sunday 21 September 2025 (‘Competition Period’)
2.b Entries received outside the Competition Period will not be eligible or accepted.
2.c Entries that are incomplete, illegible or indecipherable will not be valid and will be deemed void.
2.d Entry is conditional upon take a photo in the photo booth at the Chemist Warehouse photobooth at the Australian Fitness Expo activation, post the photo on Instagram with the Hashtag #HouseOfSportNutrition for your chance to win.
2.e The Promoter takes no responsibility for entries that are lost, stolen, illegible, misdirected or damaged however caused.
2.f Submitting an entry constitutes acceptance of these terms and conditions.
3. Who May Enter
3.a The Competition is open to Australian permanent residents over 18 years of age.
3.b The Competition is not open to:
(i) Employees of the Promoter.
(ii) Parties to whom the Promoter has contracted work in relation to this Competition;
(iii) Parties who are otherwise directly involved with this Competition; and
(iv) Any immediate family members or any of the above mentioned parties.
4. Prize
4.a A $500 Chemist Warehouse Gift Card
4.b Total Prize value is $500
5. Selecting the Winner
5.a The Competition winners will be selected by 3.00pm on Monday 22 September 2025
5.b The Competition winners will be notified by direct message on Instagram within three (3) days of the Promotion Period ending.
5.c If within one month after the determination of the winners of the lottery, a prize (other than a prize consisting of perishable goods) has not been claimed by the winner, the promoter must take all reasonable steps to deliver the prize to the prize winner. At the conclusion of the one month if the prize cannot be delivered, the promotor can re-determine the winner of the prize.
5.d If the prize is unclaimed, the Promoter will re draw on Thursday 13 October 2025 at 10.00amat 6 Albert Street, Preston VIC, 3072. The re drawn winner will be contacted in writing on Thursday 13 November 2025.
5.e A person purporting to be a prize winner may be required to provide proof of identity and to verify any other eligibility requirements.
5.f Subject to the unclaimed prize draw clause, if for any reason a winner does not take/redeem the prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
- Privacy and use of personal information
6.a In accordance with the Privacy Act (1988) (Cth), the Promoter notifies entrants that entry to the Competition involves the collection of personal information about entrants, such as their name, address, mobile phone number and email address. This is collected for the purpose of establishing eligibility, carrying out the Competition and notifying the winner. If the information is not provided, the entrant may not participate in the Competition. Entrants’ personal information may be disclosed to State Lottery agencies and winner’ name published as required under the relevant lottery legislation.
6.b Each entrant consents to the Promoter using their personal information provided in connection with their entry, for the purposes of undertaking any investigation in connection with verifying the identity of an entry or any suspected tampering.
6.c Each entrant consents to the Promoter and its authorised licensees using the entrant’s name, likeness, image and/or photograph and voice in the event that they are the winner, in any media for an unlimited period of time, without remuneration or compensation, for the purposes of promoting the outcome of this Competition.
7. Discontinuation of the Competition or Disqualification of an Entrant
7.a Subject to State legislation; The Promoter reserves the right to discontinue the Competition at any time and in its sole and absolute discretion may cancel, terminate or modify the Competition without the need to provide compensation to entrants or attempted entrants.
7.b The Promoter reserves the right, in its sole and absolute discretion to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with (or whom the Promoter reasonably suspects has tampered with) the entry process or the winner selection process or who has otherwise been misleading or fraudulent in the course of the Competition.
7.c If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
8. Exclusion of Liability
8.a The Promoter makes no representation nor provides any warranties as to the quality or suitability of the prizes offered.
8.b The Promoter is not responsible for any losses associated with any change to the value of any prizes.
8.c To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained by any person or to personal property including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter or its servants or agents, in connection with the arrangements for the supply of any goods or services by any person to the prize winner and where applicable, to any person or persons accompanying the prize winner.
8.d The Promoter accepts no responsibility for any tax implications arising from a winner receiving a cash prize and the entrant must seek their own independent financial advice. If, for GST purposes, this promotion results in any supply being made for non-monetary consideration, entrants must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
8.e The Promoter’s decision on all matters relating to this Competition will be final.
8.f The Promoter is under no obligation to provide reasons for any of its decisions.
8.g The Promoter is under no obligation to engage in any form of correspondence whatsoever with entrants or purported entrants, or their representatives, in any matters relating to the Competition.
